Creating your finished audio file can take anywhere from 10 days to perhaps three weeks or more depending on what you want done, the length of your poem, and the existing schedule here at FarForeverSky. A stand-alone professionally recorded and meticulously edited recitation can often be delivered within a week. Of course, if you want a recitation with original music, i.e. a complete “poemtrack”, that takes more time. How much more depends on the length of your poem and the style of music used. A poemtrack with a solo piano, woodwind, or guitar, for example, will take less time than a score involving an orchestra or rock track.

Once your Poemtrack is approved by you and fully paid for, you’ll receive two mp3 files; a stand-alone recording of your poem or other work to use any way you wish, and your finished Poemtrack consisting of that stand-alone recording mixed with original music from FarForeverSky.  Plus, as explained below, you’ll automatically be granted one of two world-wide licenses from FarForeverSky LLC to use that music as part of your Poemtrack.

For example, provided the use is consistent with copyright and applicable laws, you can sync your Poemtrack to a video. Make copies. Sell copies or give them away. Sell the rights to your Poemtrack and transfer your license to the underlying music without having to pay any additional licensing fees to FarForeverSky LLC.

Just bear in mind that you don’t own the music used in your Poemtrack; you have a license to use it as part of your mp3 and you won’t receive a separate audio file of the music. Among other things, this helps keep the cost of your Poemtrack affordable.

So, which license is for you? Depending on the music you choose, you’re automatically granted either an exclusive world-wide license to use the music forever as mixed in your Poemtrack, or a non-exclusive world-wide license to use the music as mixed in your Poemtrack.

If you choose original music composed and created especially for you and your poem, you’re automatically  granted an exclusive, world-wide license to use that piece in your Poemtrack. The advantage of this license is that FarForeverSky will never license that music to anyone else for any other use. Period. Though we may ask your permission to use your Poemtrack for advertising and marketing purposes.

On the other hand, if you license a piece of music I’ve already created, for example something you heard on this website as part of an existing Poemtrack, you’re granted a non-exclusive world-wide license to use that piece in your Poemtrack. Since it’s a non-exclusive world-wide license it may appear in other Poemtracks or in other places. The advantage of this license is it’s less expensive because I don’t have to create the music from scratch!

In either case, you can use your mixed Poemtrack in any legal way. However, with both licenses you are forbidden from stripping the embedded music from the mix. That’s because, though you own your mixed Poemtrack and can use it as described above, you’re only granted a license to the music within. That license precludes your stripping the underlying music to use in any another way, say, with another poem or project, or by selling it.

Also, please note that in order to provide your Poemtrack and music license, you represent and guarantee you have copyright to any material you send me. This helps everybody; you, me, and all copyright holders by helping cut down on copyright infringement.

An unaccompanied audio file of your professionally recited poem can cost as little as $95. Of course, if your poem is fairly long it will cost more. Remember that every poem you write represents a substantial investment of your time and talent, as well as a unique challenge and opportunity. 

Rates for poemtracks reflect the length of your poem and the complexity of its musical accompaniment. A four or five verse poem supported by a solo piano or unison string section can be created for as little as $595 to $795. A long poem with a complex multi-instrument track may cost $2500. To keep costs as low as possible, I create every poemtrack myself employing a palate of sampled instruments curated over many years. I also occasionally use loops and synthesizers when appropriate. Here’s the  music license you’re automatically granted from FarForeverSky LLC when your exclusive Poemtrack is paid for and delivered to you:

Upon receipt of the total cost of the item or items referenced in this Invoice, and subject to the following terms and conditions, Farforeversky LLC grants to purchaser (herein referred to as “Client”), the following license to those items.

License

Definitions:

a.) “Poemtrack”; a recorded narration, provided either by Farforeversky LLC or supplied by the Client, mixed with music created and solely owned by Farforeversky LLC, as well as the audio file in which that mix is embedded.

b.) “Bespoke music”; a music composition and recording created at the behest of, and exclusively for, Client.

This license grants Client the right to use music contained in the Poemtrack referenced by Client’s invoice under the following terms and conditions:

1. Any music forming part of the Poemtrack is licensed to Client worldwide and in perpetuity in connection with any use, marketing, distribution, copying, sale, or other legal commercial exploitation of the Poemtrack in which it is contained. This license is either exclusive or non-exclusive as defined under 5 and 6 below.

2. Farforeversky LLC warrants it has all rights whatsoever, including, but not limited to, copyright to the music contained in the Poemtrack.

3. The rights to all music forming any part of the Poemtrack, including both the compositions themselves and the recordings of those compositions, remain the sole and exclusive property of Farforeversky LLC including copyright and all other rights whatsoever not expressly granted by this license.

4. Client is prohibited from extracting any music from this Poemtrack and from using such extracted music in any way for any purpose whatsoever.

5. If the music contained in this Poemtrack is bespoke music, Client is granted an exclusive, worldwide license to it in perpetuity and Farforeversky LLC warrants that it will not license or otherwise use that music for any purpose whatsoever other than as part of this Poemtrack.  However, Farforeversky LLC may ask Client’s permission to use the Poemtrack for promotion, marketing, and advertising purposes.

6. If the music contained in the Poemtrack is not bespoke music, Client is granted a non-exclusive, worldwide license in perpetuity. Accordingly, in addition to copyright and all other rights whatsoever, Farforeversky LLC expressly retains the right to license that music to other Clients, individuals, or entities of any kind, or for other Poemtracks, or for any other use.
